境外申办外国人来华长期工作许可手续
Procedures for foreigners to apply for long-term work permits in China
对于近期需要入职中国企业的外国朋友，首次申办外国人来华工作许可，需入境前需先申办《外国人工作许可通知》，入境后15 日内办理《外国人工作许可证》，可按以下两个步骤办理：
For foreign friends who need to join a Chinese company in the near future and apply for a foreigner's work permit for the first time, they need to apply for the "Foreigner Work Permit Notice" before entering the country, and apply for the "Foreigner Work Permit" within 15 days after entering the country. Steps:

A. 网上申请
A. Online application
用人单位登录“系统”——选择“申请外国人工作许可通知（入境前）
模块—— 选择人才类别（根据申请人的条件，选择A、B、C类之一）。
The employer logs in to the "system" - select "Notice of Applying for a Work Permit for Foreigners (Before Entry)
Module - Select the talent category (according to the applicant's conditions, choose one of the A, B, C categories).
a.在线填写。
a. Fill out online.
1、按系统提示如实填写个人和用人单位的聘用相关信息，填写信息与附件材料信息一致；
1. According to the system prompts, fill in the employment-related information of the individual and the employer truthfully, and the filled-in information is consistent with the information in the attached materials;
2、学历填写学士及以上学历(如果学士以下学历只需填写最高学历）；
2. The degree should be filled in with a bachelor’s degree or above (if the degree below a bachelor’s degree is only required to fill in the highest degree).
3、工作经历填写毕业后或近十年至今的连续工作经历；

4、填写完后，打印《外国人来华工作许可申请表》，申请人签名和单位盖章后扫描作为附件材料上传至系统。

b.上传材料。
按表格清单材料逐一上传，所有材料须上传原件彩色扫描件或拍照上传至对应附件栏中。

B.预审
受理机构应当自网上材料提交成功之日起 5 个工作日（材料提交当日不计算在期 间内）内进行预审。材料不齐全、内容不规范的，受理机构应当一次性在线告知补正补齐事项；材料齐全、内容规范的，预审通过。
B. Pre-trial
The acceptance agency shall conduct pre-examination within 5 working days from the date of successful submission of online materials (the date of submission of materials is not counted in the period). If the materials are incomplete and the content is not standardized, the acceptance agency shall notify the supplementary items online at one time; if the materials are complete and the content is standardized, the pre-examination will be passed.
C.受理
受理机构对材料进一步审核，审核通过的提交审查。

The accepting agency will further review the materials, and those that pass the review will be submitted for review.
D.审查
受理后决定机构应当在 5 个工作日内进行审查并作出决定。审查不通过的，退回用人单位并说明原因，用人单位按说明要求进一步提交补充材料再次提交申请。
D. Review
After acceptance, the decision-making body shall review and make a decision within 5 working days. If the examination fails, it shall be returned to the employer and the reasons shall be explained, and the employer shall submit further supplementary materials according to the instructions and submit the application again.

决定通过的，系统将自动生成《外国人工作许可通知》，并通过网上系统信息交换至外交部门（驻外使、领馆），用人单位可在系统用户端自行下载《外国人工作许可通知》并发送给申请人。申请人凭《外国人工作许可通知》及其他办理签证所需材料到所选定的驻外使、 领馆办理Z字或R字签证入境。
If the decision is passed, the system will automatically generate the "Notice of Work Permit for Foreigners", and exchange the information to the foreign affairs department (embassies and consulates abroad) through the online system. The employer can download the "Notice of Work Permit for Foreigners" on the system user side and sent to the applicant. Applicants should go to the selected embassy or consulate abroad to apply for a Z or R visa to enter the country with the "Notice of Work Permit for Foreigners" and other materials required for visa application.
办结时限：自受理之次日起开始计算，5个工作日内作出决定。每次退回用人单位补充材料后再次提交审核，受理时间重新计算。
备注：需严格按照以上程序开展，避免不清楚流程而导致申请多次退回或办理不成功。
Time limit for settlement: It will be calculated from the day after the acceptance, and a decision will be made within 5 working days. Each time the supplementary materials are returned to the employer and submitted for review again, the acceptance time will be recalculated.
Remarks: It is necessary to strictly follow the above procedures to avoid unclear procedures, which may cause the application to be returned multiple times or unsuccessful.
02入境后方可申领《外国人工作许可证》
02 You can apply for the "Foreigner Work Permit" after entering the country
A.网上申请
登录“系统”——点击“申请外国人工作许可证（入境后）”模块，准确填写 Z 字或 R 字签证相关信息。
A. Online application
Log in to the "system" - click the "Apply for a foreigner's work permit (after entry)" module, and fill in the relevant information of the Z or R visa accurately.
B.上传材料
按表格清单上传相关材料。入境前体检采用承诺制的，入境后补充境内指定机构出具的有效体检证明。
B. Upload materials
Upload relevant materials according to the list of forms. If the pre-entry medical examination adopts the commitment system, the valid medical certificate issued by the designated domestic institution shall be supplemented after entry.
C.网上预审
受理机构应当自材料提交之次日起 5 个工作日内对网上提交的材料进行预审。材料不齐全、内容不规范的，受理机构应当一次性在线告知补正补齐事项。

The acceptance agency shall pre-examine the materials submitted online within 5 working days from the day after the materials are submitted. If the materials are incomplete and the content is not standardized, the acceptance agency shall notify the supplementary items online at one time.

E.审查
受理机构对材料进一步审查，审查通过的提交决定机构审批。审查不通过的，退回用人单位并说明原因，用人单位按说明要求进一步提交补充调查材料再次提交。 （如前后提供的材料有出入或存在不真实，可能会直接导致被拒不受理）
E. Review
The accepting agency further examines the materials, and submits the approved materials to the decision-making agency for approval. If the review fails, it shall be returned to the employer and the reasons shall be explained, and the employer shall further submit supplementary investigation materials according to the instructions and submit them again. (If the materials provided before and after are inconsistent or untrue, it may directly lead to rejection.)
F.决定
决定机构审批通过的，作出准予行政许可决定，系统显示“证件信息已查验”，用人 单位可领取证件；决定不通过的，作出不予许可决定，并说明原因。
F. Decide
If it is approved by the decision-making agency, it will make a decision to grant the administrative license, the system will display “the certificate information has been checked”, and the employer can collect the certificate; if the decision is not passed, it will make a decision not to grant the license and explain the reasons.
G.取证
G. Forensics
办结时限：决定机构自材料受理之次日起开始计算，5个工作日内作出决定。审核过程中发现材料不符合要求并退回的，用人单位应尽快按提示一次性完善申请材料并重新提交审核，每次提交材料的受理时间重新计算。
Time limit for settlement: The decision-making agency will start counting from the day after the materials are accepted, and make a decision within 5 working days. If it is found that the materials do not meet the requirements and are returned during the review process, the employer should follow the prompts to complete the application materials at one time and submit them for review again as soon as possible, and the acceptance time for each submitted materials will be recalculated.
03外国人就业要求
03 Employment requirements for foreigners
1、外国人在中国就业须具备下列条件：
（一）年满18周岁，身体健康；
（二）具有从事其工作所必须的专业技能和相应的工作经历；
（三）无犯罪记录；
（四）有确定的聘用单位；
（五）持有有效护照或能代替护照的其他国际旅行证件。
1. Foreigners seeking employment in China must meet the following conditions:
(1) Be at least 18 years old and in good health;
(2) Possess the necessary professional skills and corresponding work experience for his/her work;
(3) No criminal record;
(4) There is a definite employing unit;
(5) Hold a valid passport or other international travel documents that can replace the passport.
2、用人单位与被聘用的外国人应依法订立劳动合同。劳动合同的期限最长不得超过五年。
2. The employer and the employed foreigner shall conclude a labor contract in accordance with the law. The maximum term of the labor contract shall not exceed five years.
同时用人单位也应该注意入职的一些条件。劳动合同签订的期限不能过长是需要特别注意的，虽然很多国家跟我国的成年的年龄规定有所不同，但是在我国入职仍然是需要年满18周岁的。
At the same time, employers should also pay attention to some conditions for entry. Special attention should be paid to the fact that the period for signing a labor contract cannot be too long.
